Terms of Service
These Terms of Service (“Terms”) govern your access to and use of https://h2opoolcare.com (the “Site”) and any request for information, estimates, scheduling, or services provided by H2O Pool Care (“H2O Pool Care,” “we,” “us,” or “our”).
By using the Site or contacting us through it, you agree to these Terms. If you do not agree, do not use the Site.
1) Services and Information Only
The Site provides general information about our pool care services and may allow you to request a quote, schedule service, or contact us.
All information on the Site is provided for general informational purposes only and may change without notice. Any quote or availability is not final until confirmed by us.
2) Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to request services or submit information through the Site.
3) Requests, Quotes, and Scheduling
When you submit a form or contact us, you agree to provide accurate and complete information. We may need additional details to provide pricing or service recommendations.
- Quotes/estimates may be based on the information you provide and may change after an on-site assessment.
- Scheduling is subject to availability, route planning, weather, and other operational factors.
- We may decline or cancel requests at our discretion (for example, if an address is outside our service area or conditions are unsafe).
4) Customer Responsibilities (Access & Safety)
To receive service, you agree to:
- Provide safe and reasonable access to the pool/spa and equipment (gate codes, lock access, pets secured, etc.)
- Ensure the service area is reasonably clear and safe
- Maintain equipment in safe operating condition and inform us of known hazards (electrical issues, leaks, unstable decking, etc.)
- Ensure proper water level and utilities (water/electric) as needed for service
If access is not available or conditions are unsafe, we may skip service, reschedule, or charge a trip/service fee as permitted by law and/or your service agreement.
5) Service Limitations and Disclaimers
Pool and spa conditions depend on many factors (weather, usage, underlying equipment issues, water source, landscaping debris, algae contamination, etc.). While we aim for excellent results, you acknowledge:
- We do not guarantee a specific water appearance or chemical readings by a specific date unless explicitly stated in writing.
- Some outcomes may require multiple visits, additional treatments, or repairs.
- Recommendations are based on professional judgment, but results can vary.
Any maintenance, cleaning, or chemical service does not replace the need for proper equipment function. If equipment is malfunctioning, water quality may be affected.
6) Payments, Fees, and Billing (If Applicable)
If you purchase services, you agree to pay the amounts disclosed to you. Payment terms may be described in your quote, invoice, or separate service agreement.
You authorize us (or our payment processor) to charge the payment method you provide for approved charges, including recurring charges if you enroll in recurring service.
Late payments may be subject to late fees or service suspension as permitted by law.
(Optional: If you do NOT take payments through the site, remove/shorten this section and keep payment terms in your invoices/service agreement.)
7) Cancellations and Rescheduling
You may request cancellation or rescheduling by contacting us as early as possible. Same-day changes may not be available and may be subject to a fee depending on staffing and route scheduling.
We may also reschedule due to weather, safety issues, equipment access issues, or other circumstances beyond our control.
8) Communications; Calls and Text Messages
By submitting your contact information, you consent to receive communications from us related to your inquiry or services, including calls, emails, and text messages (SMS), including via automated systems where permitted by law. Message and data rates may apply.
You can opt out of marketing messages at any time. For SMS, you may reply STOP (if applicable) or contact us.
